Free Trial comes with a one-time 10 hours of listening that never resets monthly; decide whether to pay once you've used it up. ### What happens when I run out of hours? Listening doesn't stop. Hemory keeps listening, but audio stays on your listening device and is no longer uploaded for processing — with no quota to process it, your audio shouldn't leave the device. Top up and those segments can be processed; memories already generated are untouched. ### What counts as listening time? Only time when someone is actually speaking. VAD (voice-activity detection) filters out silence, gaps, and background noise — none of it consumes your hours, so leaving it on all day costs far less than it sounds. ### If I unsubscribe, do I keep my memories? Yes. Unsubscribing only stops new transcription hours; memories and transcripts you've generated stay and remain viewable. Data is permanently deleted only when you delete your account. ### Where does my audio live? Is it used to train models? No. We never use your audio, transcripts, or voice feature data to train or improve any AI model. Raw audio is kept only briefly for transcription and then permanently deleted — never stored long-term; audio on your listening device stays local and can be managed or deleted any time. ### Do the plans differ in features? No. All four plans share every capability — transcription, auto-refinement, activity splitting, speaker identification, the Q&A agent, MCP, Apple Watch, scheduled listening. You're only buying listening hours. ### What languages are supported? The product ships in 9 languages; transcription supports 100. ### Can I get a refund? How do I cancel? Subscriptions go through the App Store. Cancel any time in Settings → Subscriptions; service continues to the end of the period. Refunds follow Apple's policy at reportaproblem.apple.com. ## Start building your memory palace Download Hemory — from today on, every real conversation becomes material you can generate from tomorrow. CCPA/CPRA and GDPR rights. **Effective Date:** September 17, 2026 **Provider:** Beautiful ONES Inc., 250 W El Camino Real #1112, Sunnyvale, CA 94087, USA This Privacy Policy ("Policy") explains how Beautiful ONES Inc. ("Hemory", "we", "us") handles your Personal Information when you use the Hemory mobile applications, the Apple Watch companion, web consoles, and related services (collectively, the "Services"). We are the data controller. "Personal Information" means information relating to an identified or identifiable individual. By using the Services, you accept the practices described here. If you do not agree, do not use the Services. If you are a California resident, please also see the California Privacy Rights (CCPA/CPRA) section. If you are in the EEA or the UK, please also see the Your Rights and Cross-Border Data Transfers sections. ## 1. Information We Collect ### Information you provide - Account information: email, display name, optional avatar, birth year, and the jurisdiction in which you primarily use the Services. Payment is processed by Apple (or the relevant app store); we do not receive your full payment-card details. - Audio recordings that you initiate, and transcripts and derived text generated from them. - Voiceprints / biometric identifiers, only if you enable speaker labeling (see the Sensitive & Biometric Information section). - Communications information when you contact support. ### Information about others Recordings you submit may contain the personal information or voices of third parties. You are responsible for providing required notices and obtaining required consents before recording (see the Terms of Service, Recording Consent). ### Information collected automatically - Usage information: timestamps and events (record, edit, delete, share), feature usage, and transaction records. In the mobile apps, we use PostHog (hosted in the European Union) to record a small set of product-usage events — such as opening the subscription page or app launches — linked to a pseudonymous account identifier, to help us improve the Services. We do not enable session replay, and we never send the contents of your recordings, transcripts, or voiceprints to PostHog; this data is not used to target ads to you. - Device information: device identifiers (UUID), IP address, device model, OS, and app version. - Semantic vectors derived from your transcripts to power search and the memory graph. - Approximate location, inferred from your IP address. - Cookies and similar technologies on our website and web consoles (see the Cookies & Similar Technologies section). - Advertising measurement events on the marketing website (page visits and download-button taps attributed to our ads) — collected automatically for visitors outside the EEA, the UK, and Switzerland, and for visitors in those regions only after they consent through our banner. - Attribution and advertising-measurement data in our mobile apps: an install identifier generated by our mobile measurement partner's SDK (on Android, also the Google Advertising ID; on iOS, the IDFA only if you allow tracking), the device and app information that SDK collects, a pseudonymous account identifier, a small set of in-app events, and subscription transaction amounts (see the Third-Party Attribution & Advertising Measurement section). ### Information from third parties If you sign in through a third-party identity provider (e.g., Apple, Google), we receive basic profile information such as your name and email. We receive transaction confirmations from the app store. ## 2. How We Use Your Personal Information - To set up and administer your account, in performance of our agreement with you. - To provide the Services — recording, transcription, AI Q&A, search, and the memory graph — including, with your consent, transmitting content to third-party LLM providers. - To maintain, secure, and improve the Services and develop new features. - To communicate with you, including operational messages and, with your consent or where otherwise permitted, marketing communications. You can opt out of marketing emails at any time via the unsubscribe link or by contacting us, and we will give effect to your request promptly. - To prevent fraud, enforce our terms, defend legal claims, and comply with legal obligations. **We do NOT use your User Content (audio, transcripts) or your voiceprints/biometric identifiers to train or improve any machine-learning or AI model.** ## 3. Aggregated & De-identified Data We may create and use aggregated or de-identified data — data that does not identify, and cannot reasonably be used to identify, you — for purposes such as analytics, understanding usage trends, and improving and securing the Services. We maintain such data in de-identified form and do not attempt to re-identify it. For the avoidance of doubt, we do not use your User Content or your voiceprints/biometric identifiers to train or improve any machine-learning or AI model. ## 4. Cookies & Similar Technologies On our web consoles we use strictly necessary cookies (for login, authentication, and security), functional cookies (to remember preferences), and limited analytics cookies to operate and improve the Services. On this marketing website, we use PostHog for privacy-friendly, cookieless product analytics — it does not store analytics cookies in your browser. We also set a first-party cookie (`hm_geo`) that remembers only whether your connection appears to originate from the EEA, the UK, or Switzerland; we use this single-purpose signal to decide whether to ask for your consent. For visitors from the EEA, the UK, or Switzerland, the X (Twitter) advertising pixel — which sets its own cookies to measure the performance of our advertising, for example that you visited the site or tapped a download button after clicking one of our ads — is loaded only if you accept in our consent banner. If you decline, nothing is loaded and nothing is set; your choice is stored in a first-party cookie (`hm_x_consent`) for 12 months, and you can change it at any time via "Cookie preferences" in the footer. Visitors from other regions are not shown the banner; they can block the advertising pixel and its cookies at any time through browser settings or a content blocker. We have also integrated the Singular Website SDK on this marketing website for advertising measurement (see the Third-Party Attribution & Advertising Measurement section). It is never loaded for visitors from the EEA, the UK, or Switzerland — it is blocked outright in those regions rather than offered through the consent banner described above. You can block cookies through your browser settings, but some features may not function. Our mobile apps do not rely on third-party advertising cookies, and we do not use your content for advertising. ## 5. With Whom We Share Your Personal Information **We do not sell, and do not "share" (as defined under the CCPA/CPRA), your personal information, including sensitive personal information and biometric information. We share personal information only with:** - Cloud infrastructure providers, including Amazon Web Services (servers located in the United States), for hosting and storage. - Third-party LLM providers — which may include Anthropic, OpenAI, and Microsoft Azure — to which, with your consent, content is transmitted to provide AI features. These providers act as our service providers / processors and are contractually restricted from using your content for their own purposes or for training. - Payment processing through Apple or the relevant app store, under their own policies. - Identity providers you choose to sign in with (e.g., Apple, Google). - Singular, our attribution partner, for measuring the performance of our own advertising (see the Third-Party Attribution & Advertising Measurement section immediately below). - Law enforcement, public authorities, or others where legally required, or to protect rights, property, or safety, consistent with applicable law. - Acquirers in a merger, acquisition, financing, or sale of assets, subject to this Policy. ### Third-Party Attribution & Advertising Measurement To measure whether our advertising works — for example, whether someone who saw one of our ads on X (Twitter) went on to install the app or subscribe — we use **Singular** (a mobile measurement provider based in the United States) as our attribution partner, and we share the following with them: - **Device and install identifiers** generated by the Singular SDK in our mobile apps — **on Android this includes the Google Advertising ID (GAID), and on iOS the IDFA only if you allow tracking**, see the platform breakdown below — together with the device and app information that SDK collects (such as device model, operating system and app version, and IP address), and a pseudonymous account identifier that lets later events be matched to the same install. - **A small set of in-app events**: completing registration, your workspace becoming ready, viewing the subscription page, starting a purchase, your first listening session, and running out of your usage allowance. We send the fact that an event happened — never the contents of your recordings, transcripts, or memories. - **Subscription transaction information**: the amount and currency of a subscription payment, so that advertising spend can be weighed against revenue. **What this means on each platform is different, so we state it separately:** - **On iOS**, the app asks for your permission through Apple's App Tracking Transparency prompt. **Only if you allow it** does the Singular SDK also read Apple's Identifier for Advertisers (IDFA). If you decline, we never access the IDFA, and install attribution relies on Apple's SKAdNetwork, which reports results to us in aggregate and is not linked to your identity. You can change this choice at any time in **Settings → Privacy & Security → Tracking**. - **On Android**, we **do** use the Google Advertising ID (GAID) to attribute app installs to our advertising. The GAID is a resettable, device-level identifier that is shared across the apps on your device. You can reset it, or delete it entirely, at any time from your device settings (usually **Settings → Google → Ads**; the exact path varies by manufacturer). Deleting it stops us — and every other app — from receiving it. On both platforms, we use this data **only** to measure the performance of our own advertising. We do not use it to build advertising profiles about you, we do not use it to target ads to you, it is never combined with your audio, transcripts, or voiceprints, and we do not sell or "share" (as defined under the CCPA/CPRA) this information. Singular acts as our service provider / processor and is contractually restricted from using this data for its own purposes. ## 6. How Long We Store Your Information Raw audio is retained by default for a limited period and then permanently (hard) deleted; it is not stored long-term. Transcripts and other User Content are your asset and are retained until you delete them or delete your account. Voiceprints are retained only as long as necessary for speaker labeling and destroyed upon expiry, upon deletion of the related content, or upon account deletion. We retain account and limited records as needed to provide the Services and to comply with law. When we delete Personal Information, we take measures to render it irrecoverable. ## 7. Your Rights Subject to applicable law, you may exercise the following rights regarding your Personal Information: - Access, correct, delete, and port your Personal Information. - Object to or restrict certain processing, and withdraw consent (including for voiceprints and AI processing) at any time. - Opt out of any sale or sharing — noting that we do not sell or share your Personal Information. To exercise your rights, contact [privacy@hemory.com](mailto:privacy@hemory.com). We will verify your identity and respond within the time required by law. We may decline a request where we have a valid legal basis, and will inform you if so. You will not be discriminated against for exercising your rights. If you are a California resident, see the California Privacy Rights (CCPA/CPRA) section below for additional rights and disclosures. Legal bases (EEA/UK). Where the GDPR or UK GDPR applies, we process your Personal Information on the following legal bases: performance of our contract with you, to provide the Services; your consent (for example, for voiceprints and AI processing, which you may withdraw at any time); and our legitimate interests in securing, maintaining, and improving the Services and preventing fraud, balanced against your rights. If you are in the EEA or the UK, you also have the right to lodge a complaint with your local supervisory authority. ## 8. California Privacy Rights (CCPA/CPRA) This section provides additional disclosures for California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"). Terms used here have the meanings given in the CCPA/CPRA. ### Categories of personal information we collect - Identifiers — email, display name, device identifiers, IP address. - Customer records — name and similar account information. - Commercial information — subscription and transaction records. - Internet or other network activity — usage and event logs. - Geolocation — approximate location inferred from IP address. - Audio and electronic information — your audio recordings, transcripts, and semantic vectors. - Sensitive personal information — account log-in credentials; the contents of your recordings and communications; and, only if you enable speaker labeling, biometric information (voiceprints). We collect this information directly from you, automatically from your use of the Services, and from identity and app-store providers, and we use it for the business and commercial purposes described in this Policy (to provide, secure, and improve the Services; account management; communications; fraud prevention; and legal compliance). **No sale; no sharing. We do not, and in the preceding 12 months did not, sell or "share" (for cross-context behavioral advertising) any personal information, including sensitive personal information. We do not knowingly sell or share the personal information of consumers under 16.** Use of sensitive personal information. We use and disclose sensitive personal information only for purposes permitted under the CCPA/CPRA — namely, to provide the Services and the features you enable. Because our use is already limited to these purposes, the right to limit does not require us to change our practices; you may nonetheless contact us with any request. ### Your California rights - Right to know and access the personal information we have collected. - Right to delete and right to correct your personal information. - Right to opt out of the sale or sharing of personal information (not applicable, as we do not sell or share). - Right to limit the use and disclosure of sensitive personal information. - Right to non-discrimination for exercising your rights. Opt-out preference signals. Because we do not sell or share personal information, no opt-out is necessary; where applicable, we honor Global Privacy Control (GPC) and similar browser opt-out preference signals on our web consoles. How to exercise. Submit requests to [privacy@hemory.com](mailto:privacy@hemory.com). We will verify your identity and respond within 45 days (extendable by an additional 45 days with notice). You may use an authorized agent who provides proof of authorization. If we deny a request, you may appeal by contacting [privacy@hemory.com](mailto:privacy@hemory.com). Under California Civil Code § 1798.83 ("Shine the Light"), we do not disclose personal information to third parties for their own direct-marketing purposes. ## 9. Sensitive & Biometric Information Audio recordings, transcripts, and voiceprints may constitute sensitive personal information. Voiceprints are created only if you enable speaker labeling, only after your explicit, informed consent, and are used solely for internal speaker recognition within your own content. We do not sell, share, or disclose voiceprints to third parties except as strictly necessary to provide the feature or as required by law, and we do not use them for training. We maintain a written retention and destruction schedule for biometric identifiers. ## 10. Children The Services are not directed to children, and we do not knowingly collect Personal Information from children under 13. If you believe a child has provided us Personal Information, please contact [privacy@hemory.com](mailto:privacy@hemory.com). ## 11. Cross-Border Data Transfers We are based in the United States, and the Services are operated from the United States. If you access the Services from outside the United States, you understand that your Personal Information may be transferred to, stored, and processed in the United States, where data-protection laws may differ from those of your country. Where required by applicable law, we implement appropriate safeguards to protect your Personal Information in connection with such transfers. ## 12. Third-Party Links & Services The Services may link to or interoperate with third-party services (such as identity providers and app stores). Information you provide directly to a third party, or that you access through a third-party service, is governed by that third party's privacy policy, not this Policy. We are not responsible for the privacy practices of third parties, and we encourage you to review their policies. ## 13. Data Security We implement physical, administrative, and technical safeguards designed to protect Personal Information, including transport encryption (HTTPS / TLS 1.2+), storage of iOS credentials in the Keychain, AES-256-GCM encryption for DPU backups, and a local-first storage design. No method of transmission or storage is completely secure, and we cannot guarantee absolute security; you transfer information at your own risk. ## 14. Contact & Complaints For questions or complaints about this Policy or to exercise your rights, contact [privacy@hemory.com](mailto:privacy@hemory.com) (Attn: Privacy Officer) or write to Beautiful ONES Inc., Attn: Privacy Officer, 250 W El Camino Real #1112, Sunnyvale, CA 94087, USA. If you are in the EEA or the UK, you may also lodge a complaint with your local supervisory authority. This is without prejudice to any other rights you may have. ## 15. Changes We may update this Policy from time to time. When we do, we will post the updated Policy here and indicate the latest revision date. Please check this page periodically. --- # Terms of Service — Hemory URL: https://www.hemory.com/legal/terms/ Markdown: https://www.hemory.com/legal/terms/index.md Hero: Terms of Service — The rules of the road. Effective date: 2026-08-02 > Hemory Terms of Service from Beautiful ONES Inc., effective August 2, 2026. Recording consent, AI processing, voiceprints, retention, arbitration. Summary: Hemory Terms of Service for Beautiful ONES Inc., effective 2026-08-02. Covers eligibility, account registration, recording consent obligations, AI processing via third-party LLM providers (Anthropic/OpenAI/Azure), biometric voiceprints (opt-in, no model training), user content ownership and retention, app-store subscriptions, self-hosted DPU responsibility allocation, binding individual arbitration with 30-day opt-out, and California governing law. **Effective Date:** August 2, 2026 **Provider:** Beautiful ONES Inc., 250 W El Camino Real #1112, Sunnyvale, CA 94087, USA **PLEASE READ THESE TERMS CAREFULLY. BY CREATING AN ACCOUNT, OR BY DOWNLOADING, INSTALLING, ACCESSING OR USING HEMORY, YOU AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE HEMORY PRIVACY POLICY, WHICH IS INCORPORATED BY REFERENCE.** These Terms of Service ("Terms") form a legally binding agreement between you ("you", "user") and Beautiful ONES Inc. ("Hemory", "we", "us", "our") governing your access to and use of the Hemory mobile applications (iOS and Android), the Apple Watch companion, web consoles, and related software and services (collectively, the "Service"). Hemory lets you capture audio on your own devices, transcribe it, and structure it into a personal memory graph that you can search and revisit. ARBITRATION & CLASS-ACTION WAIVER NOTICE. Except as described in Section 22, disputes will be resolved by binding individual arbitration, and you and Hemory each waive the right to a jury trial and to participate in any class or representative action. You may opt out within 30 days (Section 22.3). ## 1. Eligibility You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By agreeing, you represent that: (a) you meet the minimum age; (b) you have not previously been suspended or removed from the Service; and (c) your registration and use comply with all applicable laws. The Service is not directed to children. ## 2. Accounts & Registration To use most features you must register an account and provide accurate information (such as email, display name, and the jurisdiction in which you primarily use the Service). You are responsible for safeguarding your credentials and for all activity under your account, and must promptly notify us at [support@hemory.com](mailto:support@hemory.com) of any unauthorized use. We may offer sign-in via third-party identity providers (e.g., Apple, Google). ## 3. Description of the Service The Service provides three core capabilities that you control: (i) Recording, (ii) Transcription, and (iii) AI Q&A. - Recording is user-initiated only. The Service captures audio through your iPhone and/or Apple Watch when you actively start a recording. Audio is stored in a Data Plane Unit ("DPU") following a local-first design, with the local file system as the source of truth. - Transcription is orchestrated by our inference service in two tiers ("basic" and "accurate"), producing text and SRT outputs. Optionally, you may enable speaker labeling, which uses voiceprint processing as described in Section 8. - AI Q&A: on top of transcripts, our agents perform dialogue segmentation, summarization, and relationship extraction, and generate derived products such as relationship graphs. Inference is performed either by calling external third-party LLM providers over HTTP (SaaS mode) or, for self-hosted deployments, by a local inference provider (Sections 7 and 12). ## 4. Subscriptions, Billing & Cancellation Paid features are sold as auto-renewing subscriptions through the Apple App Store (and, where offered, other app stores). Billing, renewal, refunds, and cancellation are governed by the applicable app store's terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period via your app store account settings. Except where required by law or app store policy, fees are non-refundable. Prices may change with prospective notice. ## 5. License & Restrictions Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Hemory applications on devices you own or control, and to access the Service, for your personal use. You may not: (a) copy, distribute, or publicly display the Service; (b) modify, reverse engineer, or attempt to derive source code except as permitted by law; (c) circumvent security or access controls; (d) resell or provide the Service for the benefit of third parties; or (e) use the Service to build a competing product. ## 6. Recording Consent & Lawful Use You are solely responsible for ensuring that your recording is lawful. Recording laws vary by jurisdiction; some U.S. states and other countries require the consent of all parties to a conversation. You represent and warrant that, before recording any conversation, you will provide all notices and obtain all consents required under applicable law from every participant, and that you have the right to record, upload, and process the audio you submit. You agree not to use the Service to record any conversation or person where doing so would violate applicable wiretapping, eavesdropping, privacy, or publicity laws. You will defend and indemnify Hemory against any claim arising from your recordings or your failure to obtain required consent (Section 20). Hemory provides recording functionality as a tool and does not and cannot verify the lawfulness of any particular recording. ## 7. AI Processing & Third-Party LLM Providers With your consent, content you submit (including transcripts and related text) may be transmitted over HTTP to external third-party large language model providers, which may include Anthropic, OpenAI, and Microsoft Azure, in order to provide transcription, summarization, Q&A, and related AI features. These providers process the content under their own terms and security commitments. You may withdraw consent by disabling the relevant AI features or by using a self-hosted deployment with a local inference provider (Section 12). AI outputs may be inaccurate, incomplete, or biased and may not reflect Hemory's views; transcription accuracy is not guaranteed. You are responsible for exercising judgment and human oversight, and should not rely on AI outputs without independently confirming their accuracy. AI outputs do not constitute professional advice. ## 8. Biometric Data & Voiceprint Policy If you enable speaker labeling, the Service may create and process voiceprints (voice-derived biometric identifiers) to distinguish and tag speakers within your recordings. This is an optional feature that you must explicitly enable, and we obtain your explicit, informed consent before creating any voiceprint. ### Our commitments regarding voiceprints - Purpose limitation: voiceprints are used solely for internal speaker recognition within your own content. - No external sharing: we do not sell, share, or disclose voiceprints to third parties, except as strictly necessary to provide the feature to you or as required by law. - No training: voiceprints and biometric identifiers are never used to train or improve any machine-learning or AI model. - Retention & destruction: voiceprints are retained only as long as necessary for the feature and are destroyed upon expiry of the applicable retention period, upon your deletion of the related content, or upon account deletion. - Withdrawal: you may withdraw consent and disable the feature at any time. ## 9. User Content, Ownership & Deletion As between you and Hemory, you retain all ownership of your audio recordings, transcripts, and derived text ("User Content"). Transcribed text is your asset. You grant Hemory a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, process, transform, and display your User Content solely to operate and provide the Service to you and as directed by you. We do not use your User Content to train our or any third party's AI models. Retention and deletion. Raw audio is retained by default for a limited period and then permanently (hard) deleted; it is not stored long-term. You may delete transcripts and other User Content at any time and may delete your account, which removes associated User Content except where retention is required by law or for legitimate backup cycles. Once permanently deleted, User Content cannot be recovered. ## 10. User Content: Representations, Warranties & Monitoring By providing User Content, you represent and warrant that: - you are the owner of, or have all rights, licenses, and consents necessary to submit and process, the User Content as contemplated by these Terms; - your User Content does not and will not infringe or misappropriate any third-party intellectual property, privacy, publicity, or other right, or violate any law; and - your User Content is not unlawful, defamatory, or otherwise objectionable. We have no obligation to monitor User Content, but may, at our discretion and without notice, screen, remove, or restrict any User Content that we reasonably believe violates these Terms or applicable law. We are not responsible or liable for User Content. ## 11. Privacy & Cross-Border Transfers Your use of the Service is also governed by the Hemory Privacy Policy, which is incorporated into these Terms and describes the personal information we collect (including account PII, audio recordings, transcripts, voiceprints/biometric identifiers, semantic vectors, and usage logs), how we use and share it, retention, and your rights. We do not sell, and do not "share" (as defined under the CCPA/CPRA), your personal information. We are based in and operate the Service from the United States. If you access the Service from outside the United States, your personal information may be transferred to, stored, and processed in the United States, where data-protection laws may differ from those of your country. Where required by applicable law, we implement appropriate safeguards in connection with such transfers, as further described in the Privacy Policy. ## 12. Self-Hosted DPU & Responsibility Allocation The Service supports both platform-hosted DPUs (cloud version deployed on AWS servers located in the United States) and user self-hosted DPUs. Where you operate a self-hosted DPU: (a) your data resides locally within your own environment; (b) Hemory provides only binding, routing, and certificate services and does not control or store the data residing in your environment; and (c) you, as the deploying party, are solely responsible for the security, availability, and legal/regulatory compliance of your environment, including access control, backups, and data-protection obligations. ## 13. Data Security We implement commercially reasonable technical and organizational measures designed to protect data, including: transport encryption (HTTPS / TLS 1.2+); storage of iOS credentials in the Keychain; AES-256-GCM encryption for DPU backups; and standardized UTC time handling on the backend with client-side local-time conversion. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. ## 14. Communications - Text messages. We and those acting on our behalf may send SMS messages to the number you provide (e.g., for two-factor authentication). Standard carrier rates may apply. - Push notifications. If you install our app, you may receive push notifications; you can turn these off in your device settings. - Email. We may send operational emails (e.g., processing or security notices) and, where permitted, product or promotional emails. You may opt out of promotional emails via the unsubscribe link. Electronic communications as written notice. By using the Service you consent to receive electronic communications from us, and you agree that notices, agreements, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. ## 15. Acceptable Use By using the Service you agree not to: - use the Service for any unlawful purpose or in violation of any applicable law (including recording, wiretapping, privacy, or export-control laws); - interfere with, disrupt, or circumvent the security or operation of the Service, or introduce malicious code; - collect personal information about others without consent, or harass, threaten, or harm any person; - impersonate any person or entity or misrepresent your affiliation; or - attempt to access accounts or data that are not yours. ## 16. Intellectual Property & Feedback The Service and all software, interfaces, designs, models, text, and other materials provided by Hemory (excluding User Content) are owned by Beautiful ONES Inc. or its licensors and are protected by intellectual property laws. We reserve all rights not expressly granted. If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose, including improving the Service. ## 17. Copyright We comply with the Digital Millennium Copyright Act (17 U.S.C. §512). If you believe content on the Service infringes your copyright, send a notice to our designated agent: Beautiful ONES Inc., Attn: Legal (Copyright), 250 W El Camino Real #1112, Sunnyvale, CA 94087, [legal@hemory.com](mailto:legal@hemory.com). Your notice must include: a signature of the authorized person; identification of the copyrighted work; identification and location of the allegedly infringing material; your contact details; a good-faith statement; and a statement, under penalty of perjury, that the information is accurate and you are authorized to act. We will terminate the accounts of repeat infringers. ## 18. Third-Party Services & Links The Service may interoperate with or link to third-party services (such as Apple, app stores, identity providers, and LLM providers). Those services are governed by their own terms and privacy policies, are not under our control, and we are not responsible for them. Your use of third-party services is at your own risk. ## 19. Term, Termination & Modification of the Service These Terms apply from when you first accept them or use the Service until terminated. You may terminate at any time by ceasing use and deleting your account. We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms, and may modify or discontinue the Service. Provisions that by their nature should survive (including Sections 9 (deletion), 16, 17, 19, 20, 21, 22, 23, and 27) will survive. ## 20. Indemnification To the fullest extent permitted by law, you will defend and indemnify Hemory and its officers, directors, employees, and agents from any third-party claim, and any related liability, damages, losses, and expenses (including reasonable attorneys' fees), arising out of or related to: (a) your User Content; (b) your recordings or your failure to obtain any notice or consent required by law; (c) your violation of these Terms or any applicable law; or (d) your violation of any third-party right. ## 21. Disclaimers & Limitation of Liability **21.1 Disclaimers. THE SERVICE AND ALL CONTENT, TRANSCRIPTIONS, AND AI OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that transcriptions or AI outputs will be accurate or complete.** **21.2 Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, HEMORY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. HEMORY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID HEMORY IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.** ## 22. Dispute Resolution & Arbitration ### 22.1 Agreement to Arbitrate To resolve disputes efficiently, and except as described in Sections 22.2 and 22.3, you and Hemory agree that every dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration. Arbitration uses a neutral arbitrator instead of a judge or jury, allows more limited discovery than court, and is subject to very limited review by courts; an arbitrator can award the same damages and relief that a court can. This agreement to arbitrate includes all claims, whether based in contract, tort, statute, fraud, misrepresentation, or any other theory, and whether arising before or after termination. YOU AND HEMORY EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. ### 22.2 Exceptions Nothing in this Section waives either party's right to: (a) bring an individual action in small-claims court; (b) pursue an enforcement action through an applicable government agency; (c) seek injunctive relief in court in aid of arbitration; or (d) file suit in court to address an intellectual-property infringement claim. ### 22.3 Opt-Out You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice that includes your full legal name and the email associated with your account to Beautiful ONES Inc., Attn: Legal – Arbitration Opt-Out, 250 W El Camino Real #1112, Sunnyvale, CA 94087, or [legal@hemory.com](mailto:legal@hemory.com). If you opt out, this Section 22 will not apply, and any dispute will be resolved as described in Section 23. Opting out does not affect the remaining provisions of these Terms. ### 22.4 Arbitrator; Rules Arbitration will be governed by the Federal Arbitration Act and administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (the "AAA Rules"), as modified by these Terms. The AAA Rules are available at adr.org. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration agreement. ### 22.5 Notice of Arbitration; Process A party intending to seek arbitration must first send the other party written notice of the dispute by certified U.S. mail or by Federal Express (signature required), or, only if the other party has not provided a physical address, by email (the "Notice of Arbitration"). Hemory's address for notice is: Beautiful ONES Inc., Attn: Legal, 250 W El Camino Real #1112, Sunnyvale, CA 94087. The Notice of Arbitration must describe the nature and basis of the claim and the specific relief sought. The parties will make good-faith efforts to resolve the claim directly; if they do not reach agreement within 30 days after the Notice of Arbitration is received, either party may commence arbitration. All arbitration proceedings will be confidential unless the parties agree otherwise in writing. Any settlement offer made by either party must not be disclosed to the arbitrator until after the arbitrator issues a final award. If the arbitrator awards you more than Hemory's last written settlement offer made before the award, Hemory will pay you the greater of (i) the amount awarded or (ii) USD $10,000. ### 22.6 Fees; Hearing If you commence arbitration in accordance with these Terms, Hemory will reimburse your filing fee, unless your claim exceeds USD $10,000, in which case payment of fees is governed by the AAA Rules. Any in-person hearing will take place in Santa Clara County, California; however, for claims of USD $10,000 or less, you may choose to have the arbitration conducted (a) solely on documents, (b) by telephone, or (c) in person in the county of your billing address. If the arbitrator finds the claim or relief sought to be frivolous or brought for an improper purpose, payment of fees will be governed by the AAA Rules. The arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions. ### 22.7 No Class Actions You and Hemory agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Unless both parties agree, the arbitrator may not consolidate more than one person's claims or otherwise preside over any class or representative proceeding. ### 22.8 Future Changes to this Arbitration Provision If Hemory makes any future change to this Section 22 (other than a change to its notice address), you may reject the change by sending written notice within 30 days to Hemory's notice address, in which case your account will terminate immediately and the version of this Section 22 in effect immediately before the rejected change will survive. ### 22.9 Severability; Enforceability If Section 22.7 (No Class Actions) or the entirety of this Section 22 is found unenforceable, or if Hemory receives a timely opt-out notice from you, then this Section 22 will be null and void, and the exclusive jurisdiction and venue in Section 23 will govern any action arising out of or relating to these Terms. ## 23. Governing Law These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Subject to Section 22, the state and federal courts located in Santa Clara County, California will have exclusive jurisdiction over any matter not subject to arbitration. ## 24. Changes to These Terms We may modify these Terms from time to time. For material changes, we will provide reasonable advance notice through the Service or by email, and where required may ask you to accept the modified Terms. Immaterial changes are effective upon posting. Your continued use after changes become effective constitutes acceptance; if you do not agree, you must stop using the Service. ## 25. Apple App Store Terms This section applies if you use the iOS app. These Terms are between you and Hemory only, not Apple, and Apple is not responsible for the Service or its content. Apple has no maintenance or support obligation. If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for any claims relating to the app (including product liability, legal/regulatory non-conformity, or consumer-protection claims) or for third-party intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in an embargoed country and are not on any U.S. government restricted-party list. ## 26. Notice to California Residents Under California Civil Code Section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 N. Market Blvd., Suite S-202, Sacramento, CA 95834, or (800) 952-5210. ## 27. Miscellaneous & Contact These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hemory regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. We may assign these Terms; you may not assign them without our consent. Our failure to enforce any provision is not a waiver. "Including" means "including but not limited to." Once analysis is ready, it hands over to the activity card. Both the live and the saved card were redesigned, and their height now follows their content. - Passing chats: what used to be called fragments is now “passing chats”. Consecutive ones are merged into a single group you can open to see everything inside, and a lone one collapses into a single dot row instead of taking up a whole card. - When another app is holding the microphone, you now get a clear explanation instead of a generic failure. - The auto-listening page now ends with a permanent notification-permission card: a warning and a shortcut to turn them on when notifications are off, a confirmation when they are on. - The topic filter bar now shows which categories are selected. - “About” moved into the support and community card in Settings and now shows the current version. - The Android Watch beta continues: rotary paging, list and delete interactions, and starting from a notification were all rebuilt. ## Experience Improvements - The timeline’s month label now follows the selected day instead of the leftmost day in view. - Activity, topic and people cards no longer change color while pressed. - Offline and weak networks now consistently show “No network connection”, without misleading auto-retry copy; the offline preview row was removed from Subscription & Usage. - Elapsed listening time on the Apple Watch face ticks more accurately. - Sessions that cross midnight now show an absolute end date in the segment list instead of “next day”. ## Fixed - Android: listening no longer gets stuck for good after a call or another app takes the microphone. Retries continue on their own once the interruption ends, a single call is no longer split into several listening sessions, and “listening” is never shown while no audio is coming in. - Android: interruption alerts and the “Listening stopped” notification now really restart listening when tapped. - iPhone: after a failed recovery, attempts continue with backoff instead of silently stopping in the interrupted state. - Fixed activity and topic times that could be computed incorrectly and even land in the future. - Fixed the missing capture timezone on Android uploads, which filed content under the wrong day. - Fixed the listening card never leaving the timeline when processing finished with no content. - Fixed date grouping in memory search results over MCP. - Fixed the profile page’s failure state in Settings, plus several places where text was clipped at large font sizes. --- # Listening Interruption Alerts and Auto-Resume (v26.828.609792) URL: https://www.hemory.com/changelog/ Released: 2026-08-28 > Get an instant alert when listening is interrupted, resume with one tap, and let automatic retries preserve your listening time, plus polish and fixes. ## New Features - Listening interruption alerts: when listening is interrupted by a call or another system event, you'll get an instant notification on your iPhone and Apple Watch — tap it to resume. If the interruption continues, you'll be reminded again; once listening resumes or ends, the notification clears automatically. - More reliable auto-resume: after an interruption ends, listening is resumed automatically, and your listening time so far is fully preserved. ## Experience Improvements - Improved device pairing and account connections. - Improved notifications and alerts. - Improved the timeline. - Improved audio playback. - Refined multilingual copy and fixed some issues. --- # Android Watch Beta, Voiceprint Tabs, Editable Fragments (v26.822.601345) URL: https://www.hemory.com/changelog/ Released: 2026-08-21 > Android Watch enters beta, activity and fragment details gain a voiceprint tab, fragments become editable, and Apple Watch gains a new complication. ## New Features - The Android watch app is now in beta. - Activity and fragment details now include a Voiceprints tab. It shows the speaker clips still awaiting identification in that time range, so you can mark people directly. The panel highlights the most likely match, and what you mark applies everywhere. - Transcripts now tell Pending apart from Unidentified. Speakers with clips you can mark show as Pending and are tappable; those without show as Unidentified and stay greyed out. - Fragments can now be edited and deleted. You can change a fragment's title and summary, and deleting one also clears the audio from that time range. - People can be renamed or deleted from the person detail page. A new name applies to every related activity and voiceprint. - Apple Watch gains a brand mark complication, available across all four watch face families. - Timeline fragment cards now use a fixed two-line compact card with a DRIFT watermark, matching activity cards in title layout and border. ## Experience Improvements - Deleting from activity and fragment details is now a permanent trash icon, so it takes a single tap to reach the confirmation. If you have never set a theme preference, the default is now dark. - Detail pages keep a separate scroll position for each tab. - Changing your display name or uploading an avatar now confirms success, and uploads show progress while they run. - Person names and detail page titles are shown in full instead of being truncated. - Japanese and Korean now cover server messages, the Apple Watch face, and system notifications. - Fixed some issues. --- # Android In-App Updates, Watch Sessions, and Improvements (v26.815.590712) URL: https://www.hemory.com/changelog/ Released: 2026-08-14 > Secure direct-download Android updates; Watch clips gain sessions and swipe deletion, with better device management, alerts, languages, timeline, and stability. ## New Features - The Android build from our official website now supports in-app updates. The app checks for new versions when it launches, returns to the foreground, or opens the About page. Downloads support resuming, available disk space checks, and package integrity and signature verification. - Apple Watch recording clips are now organized by session. Dates, durations, and storage sizes follow the current language, and clips can be deleted with the native swipe-left gesture. - Privacy & Security now includes device management, where you can view the current device and primary listening device, and securely remove devices you no longer use. - Android now officially supports Japanese and Korean. Recording notifications and interruption alerts follow the app or system language. ## Experience Improvements - Starting listening manually no longer waits for a network check on the primary device, so it begins immediately even offline or on a weak connection. The primary listening device is now determined automatically by the device that most recently started recording. - Key interruption alerts on iPhone and Apple Watch are now time-sensitive notifications. iPhone also uses a consistent alert sound. - Timeline fragment cards now share the same style and detail page as activity cards. Feedback submitted from a failed card automatically includes the relevant time range and failure context. - Notification permission banners have been added to the four main pages. Device management, Pending Voiceprints, MCP Key creation, and subscription quota pages also received interaction improvements. - Fixed some issues. --- # Ask about an event, new date rail, Watch sync fixes (v26.812.586722) URL: https://www.hemory.com/changelog/ Released: 2026-08-12 > Follow-up questions on any event, a timeline date rail that scrolls across months, sharper speaker recognition, plus Apple Watch sync and subscription fixes. ## New - Ask follow-up questions right from an event's detail page — answers now take that event's time, people and related topics into account. - New About page: release notes, website, privacy policy and terms, all in one place. ## Improved - The date rail at the top of your timeline scrolls continuously across months. Days that hold something are marked ahead of time, so it shows up instantly on a weak connection or right after launch. - Submitting feedback no longer waits for Apple Watch logs — it goes through even when they can't be fetched. - Sharper speaker recognition, fewer mix-ups. - Clearer session messages: you can tell at a glance whether account info is only temporarily out of sync or you really need to sign in again — and the notice no longer repeats. - "Wi-Fi Only" upload on Apple Watch is now called "Low Data Mode", closer to how it is actually used. - Polish across dialogs, pull-to-refresh, the search field and settings. ## Fixed - Apple Watch kept saying segments were waiting to sync after everything had gone through, and segments captured on the watch could stall on their way up. - Subscription purchases failed at checkout. - Blank summary on the home screen after updating, and content from the previous account lingering after switching accounts. - Chinese text was clipped in the search field. --- # Hemory 1.0 — iOS & Apple Watch launch (v1.0.0) URL: https://www.hemory.com/changelog/ Released: 2026-08-01 > First public release. Not meeting transcription — a tool that keeps every conversation as memory, to revisit and build on through your AI agent. The day has finally come to ship Hemory. It's hard to believe that in an age when AI coding is everywhere, what is, on paper, a recording-and-transcription app took us nine months to build. Hemory started as a way to scratch my own itch. Later I talked [Jun](https://x.com/bushcraftjun), the CEO of WizNote, into joining. Years ago, after ONES acquired WizNote, Jun and I often talked about building the next generation of note-taking. Jun has spent more than twenty years in note-taking tools and knows the history of every notes app on the market — Obsidian and Notion go without saying. What I admire most: he still swears by Roam Research to this day (never heard of it? doesn't matter — only the old wizards know that one). He threw himself into Hemory, coding through the night, and most days I had to talk him into going home to sleep. I'd get up past eight to find that the code he'd pushed at five had already built clean. His exact words: "Note-taking software is dead." Back to what I needed. Like everyone who wants transcription, I started with meeting notes. First the software-only tools — Granola, Otter, and the rest — then hardware recorders. Plaud's hardware design is excellent; I bought one the moment it came out. But once I'd tasted what AI transcription could do, my standards went up. A few pain points these products just couldn't solve for me. **One — it has to listen and capture continuously.** I was always forgetting to start or stop the app — or the Plaud. Halfway through a meeting I'd realize it wasn't on; other times I'd notice long after a meeting had ended that it was still recording, and several meetings' worth of topics had blurred into one mush. I spend half to two-thirds of my workday in meetings, and having to constantly mind and toggle a recording app or device drained my attention. I thought about just recording nonstop, but most transcription apps cap a single file at four hours. And a day's topics can be all over the place — I didn't want them crudely lumped into one meeting file. **Two — recall what I've said and heard, from any angle.** An instant meeting memo didn't matter much to me. What I wanted was the chance to get something back when I needed to recall it. And getting it back shouldn't mean search in the traditional sense — I didn't want to punch in keywords, land on a few memos, and then have to read them. No — those memos are already lossy. What I wanted was recollection that spans time and meetings, organized around a topic. With those memories in hand, I could have AI work them up into all kinds of things. Here's the experience I wanted: within a window I set in advance — say my workday, nine to eight — a service listens alongside me to everything that happens, and with zero effort on my part, automatically uploads, transcribes, and splits the day into separate meetings based on what was actually said. I can scroll a timeline of those segmented meetings and everyday chats to review the day's topics and read the summaries; or I can use the agent I live in — Codex, OpenClaw — to talk to the service anytime, mining and working with everything it's heard about my work and life. I don't want meeting transcription. I want a tool that captures all my conversations and automatically saves them as memory. I looked around. Nothing like it existed. So we built one. **Hemory — from *Hear and Memory*. Heard, and written down.** The features are what I described above — all of them shipped. I've been building it and using it at the same time. For more than seven months now, Hemory has been on by default whenever I'm working. It's just software: it runs on an iPhone, and on an Apple Watch too. On the Watch, Hemory is smoother than any third-party recording hardware can match — I'll write a separate post on that. The moment that surprised me most: after connecting it to Codex, I asked — > What interesting things did you hear yesterday? > > What did you hear last month? > > Write up the PRD for the new features we've been discussing lately. > > Write me a half-year review based on what you've heard. > > Take the pricing strategy we've talked over several times this month and write it up as a full competitive-analysis doc. When I watched Codex pull Hemory's memory, think for a moment, and start spilling out answers — I got goosebumps. After that I never wanted to miss another day. I wanted to capture all of it. A personal second brain, a digital assistant, whatever you call it — without complete memory, it can't know who I am, where I came from, or where I'm going. Calling Hemory an assistant feels too ordinary — it's more like a clone of yourself. Once Hemory fully knows and understands how I express myself, and has heard the conversations I have with the people around me — I am him. He is me. This is a small beginning. It may sound like a small product, but our little team of obsessive perfectionists rebuilt it from scratch three times before we dared to ship. Hemory's mission is clear: **remember everything you've said and heard, and prepare lossless context for AI.** "The limits of my language mean the limits of my world" (that one's Wittgenstein) — language is also an expression of how a person sees the world. As AI grows more capable — seemingly able to do it all, and getting better at it by the day — what we think and what we say become the last thing that tells one human being from another. I once asked Hemory to guess my MBTI from everything it had heard me say. The answer was scarily accurate. Goosebumps again. I hope Hemory can be a good companion for us, helping us look outward at the world and inward at ourselves — and, along the way, quietly getting the work and whatnot done too. Download it at Hemory.com. I hope you like it.
